West v Secretary of State for Scotland : ウィキペディア英語版 | West v Secretary of State for Scotland ''West v Secretary of State for Scotland'' 1992 SC 385 (IH),1992 SLT 636, (als reported as ''West v Scottish Prison Service'', 1992 SCLR 504) is the leading case on judicial review in Scotland and sets out in detail the present law. It sets a contrast to the position on judicial review in England. ==Facts== The point at issue arose out of the articles of association of the S.F.A., to which the football club were subject as members of it, which empowered the council of the S.F.A. to fine or expel its members on grounds of which they were to be the sole judges. The case provides a clear example of the tri-partite relationship, by which a decision-making body—in this case the council—has been entrusted by an enabling body with a limited jurisdiction for decision-taking in regard to others to which it must adhere.
